This agreement

These terms are between you and SpeakUp ([registered address]). By creating an account you accept them. If you do not, do not use the service.

What the service is — and is not

SpeakUp is a language-practice application. It holds conversations with you, finds patterns in the mistakes you make, and builds exercises from them.

It is a study aid. It is not a certified qualification, and its assessments are not a formal measure of proficiency — do not present them as one.

It is also not speech therapy, and not medical advice. The Speech Studio measures acoustic properties of your voice — pace, pitch range, pauses, syllable stress — and comments on how they sound. That is pronunciation coaching, not clinical assessment. It cannot diagnose a speech, language or hearing condition, and it is no substitute for a qualified speech-language pathologist. Your account

• You need an account to use the service. You may sign up with an email address and password, or with Google.
• You are responsible for keeping access to your account secure, and for what happens under it.
• One account is for one person. Do not share it.
• You must be at least 16 years old, and old enough to enter a contract where you live.

Membership and billing

• Your first diagnostic conversation is free. Roadmaps, practice sessions, reports and coaching require an active membership.
• Payments are processed by Lemon Squeezy, our merchant of record. Their terms govern the payment itself, and they handle applicable sales tax and VAT.
• Monthly and yearly memberships renew automatically until you cancel. Cancel any time from the billing portal: cancelling stops future renewals, and your access continues to the end of the period you have already paid for.
• If your checkout offers a free trial, you will not be charged that day, and you may cancel before it ends at no cost.
• If a payment fails we keep your access on for a short grace period while it is retried, and we tell you in the app so you can fix the card.
• Prices are shown in US dollars. See pricing for current plans. We may change prices for future billing periods, never retroactively, and we will tell you before a change affects you.

The Lifetime plan and your own API key

Lifetime is a one-time payment for indefinite access to the application. AI usage is not included: it runs on an Anthropic API key you supply, and Anthropic bills you directly for what you use. That means:

• You are responsible for your own Anthropic costs. We never see that bill, cannot refund it, and cannot control it beyond the spending limits the app offers you.
• You must comply with Anthropic's own terms and usage policies when using your key here.
• Without a valid key, AI-dependent features will not run. Everything already generated stays available.
• “Lifetime” means the lifetime of the service. If SpeakUp is ever discontinued, we will give reasonable notice and a way to export your data — it does not mean a personal guarantee of immortality for the software.

Free and granted accounts

We sometimes give accounts away, with a spending limit attached. They are a gift, not a purchase: they carry no guarantees, the limit may be changed, and access may be withdrawn at any time. When the limit is reached, AI features stop and the rest of the app keeps working.

Refunds

Refunds are handled through Lemon Squeezy. Write to [email protected] and we will help. A refunded purchase ends the access it paid for. If you are a consumer in the EU or the UK you have statutory withdrawal rights, and nothing here limits them.

Acceptable use

• Don't use the service to produce unlawful, abusive, hateful or harassing content.
• Don't attempt to extract, resell or bulk-download the exercise bank, the models, or anyone else's data.
• Don't try to bypass the paywall, spending limits or rate limits, or probe the service for vulnerabilities without asking us first.
• Don't automate access in a way that degrades the service for other people. Rate limits apply and may change.
• If you record other people, that is on you — get their consent, and follow the law where you are.

AI-generated content

Exercises, corrections, explanations and coaching are produced by AI models and can be wrong — a correction may be mistaken, an explanation may be confidently misleading. Treat them as a well-informed guess, not an authority, and please report anything that looks incorrect so we can fix it.

Your content

What you write and say remains yours. You give us permission to process it in order to run the service: analysing it, maintaining your learner profile, and generating practice from it. See privacy for exactly where it goes.

Exercises generated during your use are written to be generic and join a shared bank other learners draw from. They never contain your name, your details or your own sentences.

Our content

The application, its design and its content are ours. Your membership is a personal, non-transferable right to use it — it does not transfer ownership of anything.

Availability

We aim to keep the service running, but we do not guarantee uninterrupted availability. Features may change or be removed as the product develops. Some parts depend on third parties — Anthropic, Google, Supabase, Lemon Squeezy — and an outage at any of them can take a feature down with it.

Warranties and liability

The service is provided “as is”. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, lost data, or costs you incur with a third party — including charges on your own Anthropic account. Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim.

Nothing here excludes liability that cannot legally be excluded, including for fraud, death or personal injury caused by negligence, or your statutory rights as a consumer.

Ending things

You can stop using the service at any time, and ask us to delete your account by emailing [email protected]; see privacy for what deletion removes and how long it takes. We may suspend or close an account that breaches these terms, and we will tell you why unless the law prevents it.

Changes to these terms

We may update these terms. If a change materially affects you, we will tell you in the app before it takes effect. Continuing to use the service after that means you accept the new version; if you do not, you can cancel.

Governing law

These terms are governed by the law of [country], and its courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live.
